IDOT's and the City's motions to dismiss the Original and Amended Complaint are denied as moot. The state defendants' and the City's motions to dismiss the Amended Complaint are granted.

Plaintiffs' motion for a temporary restraining order and stay pending review is denied.

Plaintiffs' Objections to Magistrate's Order are rejected.  Defendants' motion to consolidate final hearing of the action on the merits with the preliminary injunction hearing is granted.

Defendants' motion for summary judgment on CERCLA claims granted as plaintiff lacked standing, and contribution cause of action barred by previous consent decree.
